Terms of Service
These Terms of Service are a legal agreement between you and Lucina Education Pty Ltd (trading as “Classmate”, “we”, “us”). By creating an account or using the Classmate web application and related tools (the “Service”), you agree to these Terms. If you are accepting on behalf of another person (e.g., another teacher), you confirm you have authority to do so.
1. What Classmate is
Classmate provides AI-assisted tools for teachers to plan lessons and, if requested, generate supporting materials (presentations, worksheets). From time to time, we may offer optional Student Features (e.g., AI Tutor and assessments) that allow a teacher to invite their students to interact with content tied to that teacher’s lessons.
2. Accounts and eligibility
- Accounts are for individual, named users. Do not share your login.
- You must be 18+ years old. The Service is not for direct student sign-ups.
- You are responsible for all activity under your account. Tell us promptly about unauthorised use.
3. Acceptable use and fair use
You agree not to: (a) submit illegal or harmful content; (b) upload malware; (c) infringe others’ IP or privacy; (d) attempt to bypass security, rate limits, or scrape the Service; (e) misrepresent that outputs are human-authored where disclosure is required; (f) input student personally identifiable information (PII) into teacher workflows.
Fair use. Free/Pro plans include reasonable use consistent with normal teaching needs; excessive/automated generation may be rate-limited or suspended.4. Content, outputs, and our IP
- Your Content: Your prompts, class/lesson metadata, uploads, and other inputs remain yours. You grant us a licence to host, process, and display Your Content solely to provide, secure, and support the Service.
- Outputs: As between you and us, you own the lesson plans, presentations, worksheets, and files generated for you, subject to third-party materials you supply.
- Service IP: We and our licensors own the Service and underlying technology. No rights are granted except as in these Terms.
- Model training: We do not use Your Content or Outputs to train third-party foundation models. We may use de-identified/aggregated telemetry to improve quality and safety.
5. Plans, renewals, cancellations
Paid plans auto-renew monthly or annually unless you cancel before renewal. You will retain access until the end of the current billing period. Except where required by law, fees are non-refundable. We may change features or pricing and will give reasonable notice of material changes.
6. Third-party providers
We use reputable cloud, AI, and payment providers to run the Service and may change providers without notice. We remain responsible for delivering the Service to you.
7. Availability; beta features
We aim for high availability but do not guarantee uninterrupted service. Preview/beta features are provided “as is” and may change or be withdrawn.
8. Disclaimers
Classmate is an assistive tool. You must review and adapt outputs for accuracy, appropriateness, accessibility, and curriculum alignment. To the extent permitted by law, the Service is provided “as is” and “as available.” Nothing in these Terms excludes your non-excludable rights under the Australian Consumer Law or applicable New Zealand consumer laws.
9. Liability cap
To the maximum extent permitted by law, our aggregate liability for all claims in any 12-month period is limited to the fees you paid for the Service in that period. We are not liable for indirect or consequential loss, except where not permitted by law.
10. Suspension and termination
We may suspend or terminate your account for material breaches (e.g., credential sharing, prohibited content, student PII in teacher workflows, non-payment). You may terminate at any time via account settings. Post-termination data handling is described in the Privacy Policy.
11. IP concerns
If you believe something on the Service infringes your rights, email hello@classmate.ai with details; we may remove or disable access to the material and notify the user.
12. Student features
If we offer Student Features and you enable them to invite your students:
- Consent and authority: You confirm you have lawful authority and any required permissions/consents to involve students.
- Scope: Student interactions and assessment processing are for educational purposes only; no selling of student data; no targeted advertising.
- Automated scoring: Automated scoring may be used for practice/feedback; avoid high-stakes decisions based solely on automation.
Additional product-specific terms may appear in-app when Student Features launch.
13. Changes to these Terms
We may update these Terms. Material changes will be notified in-app or by email. Continued use after the effective date constitutes acceptance.
14. Governing law and venue
These Terms are governed by the laws of New South Wales (NSW), Australia, and the courts of NSW have exclusive jurisdiction, subject to non-excludable consumer protections.
